These Terms govern your access to and use of Global Habour Trust ’s websites, mobile apps, and related services (the “Services”). Please read them carefully.
Agreement & Acceptance
By accessing or using the Services, you agree to be bound by these Terms and any policies referenced here (collectively, the “Agreement”). If you do not agree, do not use the Services.
Definitions
- Account
- A profile you create to use the Services (personal, business, or trust).
- User
- Any individual or entity that accesses or uses the Services.
- Applicable Law
- All laws, regulations, and supervisory guidance in jurisdictions where Global Habour Trust operates or where you access the Services.
Eligibility & Registration
You must be legally capable of entering into contracts and not be subject to restrictions under Applicable Law (including sanctions). Business users confirm they are authorized to bind the entity.
Security & Credentials
You are responsible for safeguarding login credentials and for activity under your Account. Notify us immediately of suspected unauthorized access. We may require multifactor authentication and device verification.
Fees & Plans
Current fees and plan limits are published within the Services. We may update fees on notice as required by law. Taxes, network and correspondent charges may apply.
Payments & Transfers
- We process transfers via supported rails (e.g., SWIFT/SEPA) and aim to meet stated settlement windows; timing can depend on counterparties and compliance reviews.
- You are responsible for accurate beneficiary details and funding sufficient to cover the transfer and fees.
- We may place holds, reverse, or refuse transactions to comply with law or risk controls.
Compliance (KYC/AML/Sanctions)
We perform identity verification, source-of-funds/wealth checks, monitoring, and screening as required. You must provide accurate information and promptly update it. We cannot provide Services to sanctioned persons, countries, or activities prohibited by Applicable Law.
Acceptable Use & Prohibited Activities
You may not use the Services for unlawful, misleading, or abusive purposes, including fraud, IP infringement, market manipulation, or activity that circumvents controls. We may investigate suspected violations and take action, including reporting to authorities.
Third-Party Services
Some features rely on third-party providers. Their terms and privacy practices may apply. We are not responsible for third-party content, services, or failures beyond our reasonable control.
Intellectual Property
All content, trademarks, logos, and software are owned by Global Habour Trust or its licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the Services as permitted by this Agreement.
Suspension & Termination
We may suspend or terminate access (with or without notice where permitted) for risk, legal, or policy reasons. You may close your Account at any time unless restricted by law or ongoing investigations.
Disclaimers & Liability
The Services are provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, we disclaim implied warranties and exclude liability for indirect, incidental, special, or consequential damages. Nothing excludes liability that cannot be excluded by law.
Indemnity
You agree to indemnify Global Habour Trust and its affiliates against claims, losses, and expenses arising from your breach of this Agreement, your unlawful use of the Services, or your violation of Applicable Law or third-party rights.
Governing Law & Disputes
This Agreement is governed by the laws of Global Habour Trust ’s principal place of business (insert jurisdiction). Disputes will be resolved exclusively in the courts of that jurisdiction, except where a different forum is mandated by law.
Changes to these Terms
We may update these Terms to reflect operational, legal, or regulatory changes. Material changes will be notified as required. Continued use after the effective date constitutes acceptance.
